Terms of Service

1. The "Scope Gallop" Prevention

The Services provided are strictly limited to those itemized in the Proposal/Invoice. Any request falling outside this list will be classified as 'Out of Scope' and subject to a separate quotation or billed at our standard hourly rate of R1,250.

We do not accept scope changes via WhatsApp or informal channels; all changes must be confirmed in formal writing via our Change Request system. Any work not explicitly listed in the Proposal or Invoice is excluded by default.

2. Payment & Non-Refundable Deposit

A 50% deposit is required to schedule and commence work. This deposit secures delivery capacity, initiates project planning, and reserves time in our production schedule.

Work begins once the deposit is received and required onboarding information is provided. Because capacity is allocated immediately and cannot be resold on short notice, the deposit is non-refundable.

In accordance with the Consumer Protection Act (CPA), this deposit constitutes a reasonable cancellation penalty reflecting costs incurred, time reserved, and opportunity cost should the Client cancel prior to completion.

3. Revisions & Project Pausing

Standard packages include two (2) rounds of revisions. Additional rounds of revisions are billed at our standard hourly rate.

If the Client fails to provide feedback, assets, or approval for a period exceeding 10 business days , the project will be placed on hold. A Reactivation Fee of R2,500 applies to resume work and reallocate resources.

4. Intellectual Property (IP) Transfer

Upon full payment of all outstanding invoices, Digital Mafia grants the Client a perpetual, non-exclusive license to use the final deliverables. Ownership of background technology, frameworks, and pre-existing IP remains with Digital Mafia.

Draft work, concepts, and work-in-progress remain the property of Digital Mafia until full payment is received.

5. Project Timelines

Delivery timelines are based on timely receipt of required content, feedback, and approvals from the Client. Delays in Client input may extend the project timeline without penalty to Digital Mafia.

6. Right to Decline Engagement

Digital Mafia reserves the right to decline or terminate engagements that are misaligned with agreed scope, timelines, or professional conduct, subject to applicable law.
